Dr. Anthony Fauci, who became the public face of America’s flawed response to the COVID-19 pandemic, did not testify before the Senate Homeland Security and Governmental Affairs Committee this week as scheduled. Instead, he repeatedly invoked the Fifth Amendment more than 100 times during questioning.
This unprecedented act has prompted Senator Rand Paul of Kentucky to call for Congress to hold Dr. Fauci in contempt. Earlier this week, Paul released excerpts from Fauci’s private diary, which revealed a man increasingly fixated on his self-image and harboring significant doubts about key pandemic decisions—including the virus’s origins.
Fauci publicly projected confidence in the scientific consensus while privately questioning its validity. In contrast, Florida under Governor Ron DeSantis adopted an approach that prioritized state-level decision-making during the pandemic. By 2020, Florida was among the first states to reopen restaurants and beaches without federal mandates, required in-person school attendance for the fall of 2020, and blocked local vaccine requirements by late 2021.
Fauci labeled DeSantis a “complete disgrace” in his diary. Yet Florida’s age-adjusted COVID mortality rate ranked 31st nationally during the pandemic—significantly lower than states like New York and New Jersey that implemented strict lockdowns and school closures. The state also recorded the largest annual net migration between July 2020 and July 2021, according to U.S. Census data. DeSantis has since secured re-election with a large margin and a Republican supermajority in both chambers of the Florida Legislature.
This outcome demonstrates what Justice Louis D. Brandeis described in his 1932 Supreme Court dissent: “It is one of the happy incidents of the federal system that a single courageous State may, if its citizens choose, serve as a laboratory; and try novel social and economic experiments without risk to the rest of the country.”
