Illinois Gov. JB Pritzker has signed House Bill 460 into law, making immediate effect pending Jan. 1 implementation. This legislation amends the RISE Act to extend state-funded scholarships, grants, and stipends to illegal immigrants who meet residency requirements.
The move comes amidst significant political backlash from Republican lawmakers in the state senate. They argue that providing financial aid benefits equitably to individuals residing illegally within the United States creates an inequitable system where citizens may be perceived as second-class residents.
The law has drawn criticism from opponents citing its potential conflict with federal regulations regarding educational assistance. “Under federal law, schools cannot provide benefits to illegal aliens that they do not provide to U.S. citizens,” a statement reflects concerns over legal compliance and national policy alignment.
Furthermore, the legislation includes a carve-out for individuals exempt from registering for Selective Service, raising questions about fairness and mandatory national service obligations among critics.
State data indicates Illinois is home to more than 500,000 immigrants without legal status. Notably, nearly 27,000 of them are currently pursuing higher education within the state borders.
